These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Serplora Academy ("Serplora Academy", "we", "our", or "us"), governing your access to and use of the Serplora Academy website, platform, and all associated services (collectively, the "Platform").
By creating an account, accessing, or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Eligibility
1.1 Age Requirement
You must be at least 13 years of age to use the Platform. If you are between 13 and 18 years old, you represent that you have obtained the consent of a parent or legal guardian to use the Platform and agree to these Terms.
If you are under 13 (or under 16 in the European Economic Area), you are not permitted to use the Platform.
1.2 Legal Capacity
By agreeing to these Terms, you represent that you have the legal capacity to enter into a binding contract. If you are accessing the Platform on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. Account Registration
2.1 Account Creation
To access certain features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Keep your account credentials confidential and not share them with others
- Notify us immediately at contact@serplora.com if you suspect unauthorized access to your account
- Be solely responsible for all activity that occurs under your account
2.2 One Account Per User
You may only maintain one account per person. Creating multiple accounts to circumvent restrictions, abuse free tier limits, or exploit promotions is prohibited.
2.3 Third-Party Login
If you register using a third-party service (e.g., Google, GitHub), you authorize us to access the basic profile information provided by that service. Your use of such services is also governed by their respective terms.
3. Platform Services
Serplora Academy provides an online learning platform that includes:
- Coding Courses and Tutorials — Structured learning content covering programming languages, frameworks, and computer science concepts
- Live Coding Compiler — An in-browser code editor and execution environment for practice and experimentation
- Quizzes and Assessments — Interactive evaluations to test and reinforce your learning
- Community and Forums — Spaces for users to post questions, share knowledge, and collaborate with other learners
Availability of specific features may vary depending on your plan tier (see Section 4).
4. Free and Paid Plans
4.1 Free Plan
Serplora Academy offers a free tier that provides access to a defined set of courses, compiler usage, and community features at no cost. Free plan access may be subject to usage limits, feature restrictions, or the display of advertisements.
4.2 Paid Plans
We offer one or more paid subscription plans that provide access to additional or premium features, including but not limited to advanced courses, extended compiler usage, ad-free experience, or priority support.
4.3 Plan Changes
We reserve the right to modify the features included in any plan tier, introduce new tiers, or discontinue existing tiers at any time. We will provide reasonable advance notice of material changes to paid plan features.
5. Payments, Billing, and Refunds
5.1 Billing
Paid subscriptions are billed on a recurring basis (monthly or annually, as selected at checkout). By subscribing, you authorize us or our payment processor to charge your payment method automatically at each renewal period.
5.2 Payment Processing
Payments are processed by third-party payment processors. We do not store your full payment card details on our servers. Your payment information is governed by the privacy policy of the applicable payment processor.
5.3 Price Changes
We reserve the right to change subscription pricing at any time. If we change pricing for your current plan, we will notify you at least 30 days in advance. Your continued use of the paid plan after the price change takes effect constitutes your acceptance of the new pricing.
5.4 Cancellation
You may cancel your paid subscription at any time through your account settings or by contacting contact@serplora.com. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your paid period.
5.5 Refunds
All payments are non-refundable except where required by applicable law. If you believe you have been charged in error, contact us at contact@serplora.com within 14 days of the charge. We will review such requests on a case-by-case basis.
5.6 Taxes
You are responsible for all applicable taxes associated with your subscription, except for taxes based on Serplora Academy's net income.
6. Acceptable Use
6.1 Permitted Use
You may use the Platform only for lawful, personal, non-commercial educational purposes, unless you have entered into a separate written agreement with Serplora Academy that expressly permits commercial use.
6.2 Prohibited Conduct
You agree not to:
- Use the Platform in any way that violates applicable local, national, or international laws or regulations
- Attempt to gain unauthorized access to any part of the Platform, other user accounts, or our infrastructure
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Platform
- Use automated tools (bots, scrapers, crawlers) to access, collect, or index content from the Platform without our express written permission
- Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Use the compiler or any Platform feature to develop, test, or deploy malware, ransomware, exploits, or any code intended to cause harm
- Circumvent, disable, or interfere with security features of the Platform
- Use the Platform to send spam, phishing messages, or unsolicited bulk communications
- Reproduce, redistribute, resell, or sublicense Platform content, courses, or materials without express written authorization
- Engage in any conduct that restricts or inhibits any other user's access to or enjoyment of the Platform
Violation of this section may result in immediate account suspension or termination.
7. Live Coding Compiler & Infrastructure
7.1 Permitted Use
The in-browser compiler is provided as an educational tool. You may use it to write, test, and run code for personal learning and experimentation.
7.2 Prohibited Use
You must not use the compiler to:
- Write, execute, or distribute malicious code, including viruses, worms, trojans, or exploits
- Perform denial-of-service attacks or attempt to overwhelm any server or network
- Mine cryptocurrency
- Access or probe external systems without authorization
- Circumvent usage limits through automated or scripted requests
7.3 Usage Limits
Compiler usage may be subject to rate limits, execution time caps, or resource constraints depending on your plan. We reserve the right to throttle or suspend compiler access if we detect abusive usage patterns.
7.4 No Persistence Guarantee
Code saved in the compiler is provided as a convenience. We do not guarantee the indefinite storage of your compiler sessions or saved files. You are responsible for maintaining your own backups of important code.
8. Community and Forums
8.1 Community Standards
Serplora Academy's community spaces are intended to be respectful, inclusive, and educational. When participating in forums, discussion boards, or any community feature, you agree to:
- Be respectful and constructive toward other users
- Post content that is relevant, accurate, and helpful
- Refrain from personal attacks, harassment, or discriminatory language
- Not post spam, promotional content, or off-topic material
- Attribute others' work appropriately and not plagiarize
8.2 Moderation
We reserve the right, but have no obligation, to monitor, review, edit, or remove community content that violates these Terms or our Community Guidelines. Repeated violations may result in account suspension or termination.
9. User-Generated Content
9.1 Your Content
"User Content" means any code, text, posts, questions, answers, links, or other material you submit to the Platform. You retain ownership of your User Content.
9.2 License to Serplora Academy
By submitting User Content to the Platform, you grant Serplora Academy a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, store, modify, display, and distribute your User Content solely for the purposes of operating, improving, and promoting the Platform.
9.3 Public Content
If you choose to make code snippets or posts publicly visible (e.g., sharing a compiler link or posting in the community), you acknowledge that other users may view and reference that content.
9.4 Content Responsibility
You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not endorse or verify User Content and disclaim all liability arising from it.
9.5 Content Removal
We reserve the right to remove any User Content that violates these Terms, applicable law, or that we determine in our sole discretion is harmful to the Platform or its users.
10. Intellectual Property
10.1 Platform Content
All content on the Platform — including but not limited to course materials, tutorials, videos, quizzes, graphics, logos, and software — is owned by or licensed to Serplora Academy and is protected by copyright, trademark, and other intellectual property laws.
10.2 Limited License to Users
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Platform content solely for your personal, non-commercial educational purposes. This license does not include the right to:
- Download, copy, or redistribute course content outside the Platform
- Resell, sublicense, or commercially exploit any Platform content
- Create derivative works based on Platform content without our express written permission
- Bypass or circumvent any Digital Rights Management (DRM) or anti-piracy measures implemented on the Platform, including but not limited to video watermarking or screen recording prevention technologies.
10.3 Trademarks
"Serplora Academy" and associated logos are trademarks of Serplora LLC. You may not use our trademarks without our prior written consent.
10.4 Feedback
If you provide us with suggestions, ideas, or feedback about the Platform ("Feedback"), you grant us the right to use that Feedback without restriction or compensation to you.
11. Third-Party Services and Links
The Platform may integrate with or link to third-party services, tools, or websites (e.g., Google, GitHub, payment processors). These third-party services are governed by their own terms and privacy policies. Serplora Academy:
- Does not endorse or control any third-party services
- Is not responsible for the availability, accuracy, or content of third-party sites
- Is not liable for any damages arising from your use of third-party services
12. Advertising
The free tier of the Platform may display advertisements served by third-party advertising networks (e.g., Google AdSense). These networks may use cookies and similar technologies to serve interest-based ads. You may opt out of personalized advertising through your account settings or the provider's opt-out tools.
Paid plan subscribers may have access to an ad-free experience, as described on the pricing page.
13. Disclaimers
13.1 "As Is" Basis
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SERPLORA ACADEMY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
13.2 Educational Nature
Course content and tutorials are provided for educational purposes only. We do not guarantee that completing any course or using the Platform will result in employment, certification, or any specific outcome. Always validate skills and knowledge through official certification bodies where applicable.
13.3 Availability
We do not guarantee that the Platform will be available at all times or free from errors, interruptions, or security vulnerabilities. We may perform maintenance, upgrades, or experience downtime without prior notice.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SERPLORA ACADEMY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION — ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SERPLORA ACADEMY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow the exclusion or limitation of certain liabilities, so the above may not apply to you in full.
15. Indemnification
You agree to indemnify, defend, and hold harmless Serplora Academy and its officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
16. Termination
16.1 By You
You may stop using the Platform at any time. To request account deletion, email contact@serplora.com with the subject line "Delete My Account".
16.2 By Serplora Academy
We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the Platform. Upon termination of a paid subscription due to a Terms violation, no refund will be issued.
16.3 Effect of Termination
Upon termination, your right to access and use the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification — shall survive.
17. Governing Law and Dispute Resolution
17.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
17.2 Informal Resolution
We encourage you to contact us at contact@serplora.com before initiating any formal dispute. Many concerns can be resolved quickly and informally.
17.3 Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be resolved by binding arbitration administered by a recognized arbitration body in accordance with its rules. The arbitration shall be conducted in English.
You waive any right to participate in a class action lawsuit or class-wide arbitration against Serplora Academy.
17.4 Exceptions
Nothing in this section prevents either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will:
- Post the updated Terms on this page with a revised effective date
- Notify registered users via email at least 14 days before the changes take effect for material updates
- Display a notice on the Platform
Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.
19. Miscellaneous
- Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Serplora Academy with respect to the Platform and supersede all prior agreements.
- Severability — If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will remain in full force.
- No Waiver — Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment — You may not assign or transfer your rights under these Terms without our prior written consent. We may freely assign our rights.
- Force Majeure — We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, internet outages, or government actions.
